Terms of use
The terms for using Puanca: accounts, content, rules, reports and liability.
This English translation is provided for convenience. The Turkish version is the legally binding text; if the two differ, the Turkish version prevails.
1.Service provider and parties
These Terms of use (“Terms”) are between Abdulgaffar Ulutaş, sole proprietorship (the “Provider”), who operates the Puanca website and mobile app (“Puanca”), and everyone who uses Puanca (“user”).
Service provider information under Article 3 of Law No. 6563 on the Regulation of Electronic Commerce: name: Abdulgaffar Ulutaş, sole proprietorship; line of business: computer programming services; address: Siteler Mahallesi, 07070 Konyaaltı/Antalya; e-mail: [email protected].
2.Acceptance and age limit
By creating an account, or by continuing with Google or Apple, you declare that you have read these Terms, the KVKK privacy notice, the Cookie policy and the Review and rating policy, and that you accept these Terms.
You must be at least 18 to use Puanca, and you declare this by creating an account. Some places on Puanca serve alcohol; such content is for adult users only.
3.What the service is
Puanca is a free platform where users check in at places and share reviews and ratings. Reviews, ratings and photos are created by users. For user content, the Provider is a hosting provider under Law No. 5651: it is not obliged to check content before it is published or to investigate whether there is any unlawful activity, but it removes unlawful content in accordance with the law once it is notified of it.
Place information (name, address, hours, price range) comes from Google Maps; we don’t guarantee its accuracy. You can report wrong information from the place’s page.
4.Account and security
You are responsible for the accuracy of the information you provide and for the security of your account; don’t share your password with anyone and, if you can, turn on two-step verification. If you think your account has been used without your permission, sign out of all sessions from Settings › Account and security and write to [email protected]. Each person may use only one account; accounts cannot be transferred.
5.User content and licence
The reviews, ratings and photos you share belong to you. When you share them, you grant the Provider a free, non-exclusive, worldwide right, for as long as the content stays published, to display it within Puanca, to show it to other users according to the visibility you choose (including suggesting public content to people who don’t follow you, which you can turn off in Privacy settings), to use it in calculating place scores, to let it appear in Puanca’s share links and in search engines, and to reproduce, resize and format it technically for these purposes. This right ends when you delete the content or your account is deleted, without prejudice to statutory retention obligations.
You are responsible for making sure your content doesn’t infringe the rights of others: you must have taken the photos yourself or have the right to share them (Law No. 5846 on Intellectual and Artistic Works); you must have the consent of anyone recognisable in your photos; and you must not disclose other people’s personal data or private lives.
6.Community rules
The following are prohibited: rating a place you haven’t been to; writing a review in exchange for money, a discount, a free product or any other benefit, or hiding this; reviewing a business you own, work for, are close to or compete with; insults, threats, harassment, hate speech and discrimination; sharing other people’s personal data; obscene or violent content or content that encourages crime; content that constitutes the offences listed in Article 8 of Law No. 5651; spam, hidden advertising, fake accounts, and generating content or collecting data with automated tools; and trying to get around the service’s security.
If you have a commercial relationship with a business (for example, you were invited), you must say so clearly in your review; otherwise the review may count as hidden advertising (Regulation on Commercial Advertising and Unfair Commercial Practices).
7.Reports, removal and appeals
You can report content you believe breaks the rules or the law using the “Report” option next to it, or by writing to [email protected] with a link to the content and your reasons. Reports are reviewed by our moderators; reports of personality-rights violations, disclosure of personal data and criminal content are handled first. If you believe your personality rights have been violated, you can also apply directly to a criminal judgeship of peace under Article 9 of Law No. 5651; we apply decisions of competent authorities without delay.
Content that breaks the rules may be removed, and accounts may be warned, suspended temporarily or closed. You are told about the decision and its reasons in Activity and by e-mail. You can appeal a decision by writing to [email protected]; your appeal is reviewed again and you are told the outcome.
8.Businesses
Businesses are claimed on Puanca according to their roles on Google Business Profile. Owners can reply publicly to reviews and report reviews that break the rules, but they can’t delete or change reviews or affect the score. Scores and rankings can’t be bought, and businesses may not give users any benefit in exchange for reviews. A business that breaks these rules may lose its claim.
9.Intellectual property
The “Puanca” name and logo are registered trademarks of Abdulgaffar Ulutaş. They may not be used in any way without the Provider’s prior written permission; all rights under Industrial Property Law No. 6769 against unauthorised use are reserved.
Puanca’s design, software and all content other than user content belong to the Provider and may not be used without permission. No right or licence is granted to users beyond those expressly granted in these Terms. Collecting, copying or reusing data from Puanca in another service with automated tools is prohibited.
10.Changes to the service and ending your account
We may change, add or remove features to improve Puanca. You can close your account at any time from Settings › Delete account. We may close accounts that seriously or repeatedly break these Terms, telling the owner why.
11.Liability
Reviews and ratings are users’ own experiences and opinions; the Provider doesn’t guarantee their accuracy and isn’t responsible for your experience at any place. We work to provide the service without interruption, but outages may occur because of maintenance, faults or problems with third-party services. The Provider’s liability for intent and gross negligence and any other liability that cannot be limited by law are unaffected.
12.Commercial electronic messages
Service notifications (security alerts, verification, follow and reply notifications) are not commercial electronic messages. Messages about campaigns and promotions are sent only with the approval you give under Law No. 6563 and the Regulation on Commercial Communication and Commercial Electronic Messages; your approval is recorded in the Message Management System (İYS), and you can refuse such messages at any time, without giving a reason and free of charge.
13.Changes
We may update the Terms to reflect changes in the law or the service. We will tell you about changes that affect your rights by e-mail or in the app at least 15 days before they take effect. If you don’t accept the changes, you can close your account; continuing to use Puanca after they take effect means you accept them.
14.Governing law, disputes and evidence
These Terms are governed by the laws of the Republic of Türkiye. For disputes under Law No. 6502 on Consumer Protection, you can apply to the consumer arbitration committee where you live within the announced monetary limits, and to consumer courts above them. For disputes with businesses using Puanca as merchants or tradespeople, the courts and enforcement offices of Antalya have jurisdiction.
In disputes, the Provider’s electronic records constitute evidence under Article 193 of the Code of Civil Procedure No. 6100, subject to proof to the contrary.
These Terms take effect on the date you accept them.
